Nothing in this Policy limits any mandatory consumer rights available under applicable law.
1. 14-DAY RIGHT OF WITHDRAWAL
If you are a consumer located in the European Union or another jurisdiction providing an equivalent statutory right, you generally have the right to withdraw from an online purchase within 14 days without giving any reason.
For goods, the withdrawal period generally expires 14 days after the day on which you, or a third party designated by you other than the carrier, receive the goods.
To exercise your right of withdrawal, you must notify us before the 14-day period expires.
You may contact us at:
Email: s.marinov@destbul.com
Please include your:
- name;
- order number;
- products you wish to return;
- contact details.
You may also use the Model Withdrawal Form available on our Website.
2. HOW RETURNS ARE COLLECTED
To make the return process easier, TPC Loadout may arrange collection of the return shipment through one of our courier partners.
After your return request has been approved and registered, we will provide collection instructions or arrange for a courier to collect the package from the address agreed with you.
Unless the product is defective, incorrect or otherwise non-conforming, the customer is responsible for the direct cost of returning the goods. This is consistent with the general EU rule for withdrawal returns, provided the customer was informed of that cost obligation before purchase.
Where we arrange the courier collection on your behalf, the actual return shipping cost charged for that shipment will be deducted from the amount refunded to you.
The return shipping fee may vary depending on:
- destination country;
- parcel size and weight;
- courier;
- applicable courier rates.
We will inform you of the return shipping cost or the method used to calculate it before or during the return process where required by law.
Example
If the refundable product amount is €100 and the return courier cost is €8, the amount refunded will be:
€92
This deduction applies only where the customer is responsible for the return shipping cost.
3. CUSTOMER-ARRANGED RETURNS
Where permitted by our return instructions, you may arrange the return shipment yourself instead of using our courier collection service.
If you arrange the shipment independently:
- you are responsible for the return shipping cost;
- we recommend using a tracked shipping service;
- you are responsible for ensuring that the package is correctly addressed and adequately protected during transport.
Please do not send a return without first contacting us and obtaining the appropriate return instructions.
4. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS
Different rules apply where a product is:
- defective;
- damaged before delivery;
- materially different from the product ordered;
- missing essential components;
- otherwise not in conformity with the sales contract.
In these circumstances, TPC Loadout will bear the necessary return shipping costs.
We may arrange a courier to collect the product from you at our expense.
You will not be charged or have return shipping costs deducted from your refund where the return is accepted as a valid claim relating to a defective or non-conforming product.
Under EU consumer rules, defective or non-conforming goods must generally be repaired or replaced free of charge, including necessary costs associated with bringing the goods into conformity.
Depending on the circumstances and applicable law, the available remedy may include:
- repair;
- replacement;
- price reduction; or
- refund.
A refund is not necessarily the first remedy in every defect case; repair or replacement may apply first where legally appropriate.
5. REPORTING A DEFECT OR DAMAGED DELIVERY
If you believe that a product is defective, damaged or incorrect, please contact us at:
s.marinov@destbul.com
Please provide, where reasonably possible:
- order number;
- description of the problem;
- photographs or video showing the issue;
- photographs of the packaging if the shipment arrived damaged;
- product serial number, where applicable.
These materials help us assess the issue more quickly.
Requesting photographs does not remove or restrict your statutory consumer rights.
6. CONDITION OF PRODUCTS RETURNED UNDER THE RIGHT OF WITHDRAWAL
During the withdrawal period, you may inspect and handle the product only to the extent reasonably necessary to establish its:
- nature;
- characteristics;
- functioning.
You may handle the product in a similar way to how you would reasonably inspect it in a physical shop.
If the product has been used or handled beyond what is necessary for this purpose, we may reduce the refund to reflect any diminished value, where permitted by applicable law.
Opening ordinary product packaging does not automatically remove your right of withdrawal.
7. RETURN PACKAGING
Please return products with, where reasonably possible:
- original accessories;
- manuals;
- parts;
- included documentation;
- original product packaging.
The product should be packed securely to prevent damage during return transport.
The absence of original packaging alone will not automatically remove a statutory right of withdrawal where applicable.
However, damage or diminished value caused by unnecessary handling or inadequate packaging may affect the refundable amount where permitted by law.
8. PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL
The statutory right of withdrawal may not apply to certain products where an exemption provided by applicable law applies.
Examples may include:
- products made to your specifications;
- clearly personalised products;
- sealed goods that are not suitable for return for health-protection or hygiene reasons after the seal has been broken;
- goods that deteriorate or expire rapidly;
- products that become inseparably mixed with other goods after delivery;
- other products expressly excluded by applicable law.
An item will not lose its statutory return rights merely because we label it “final sale” or “non-returnable”.
Any legal exemption will apply only where its statutory conditions are actually satisfied.
9. REFUND AMOUNT
For a valid withdrawal, the refundable amount generally includes:
- the purchase price of the returned goods; and
- where required by law, the cost of the least expensive standard delivery method offered for the original order.
If you selected a more expensive delivery service, such as express shipping, we are generally not required to refund the additional amount above the standard delivery cost.
Where the customer is responsible for return shipping and we organise the courier collection, the return courier charge will be deducted from the refund.
For example:
Product refund: €150
Return courier charge: €10
Amount refunded: €140
If the return is due to a confirmed defect, damage, incorrect product or other lack of conformity, the return courier charge will not be deducted.
10. PARTIAL RETURNS
If you return only part of an order, we will refund the price paid for the returned items.
The original delivery cost may not be refundable where the delivery charge would have been the same if you had ordered only the products you kept, subject to mandatory applicable law.
If a promotional discount depended on purchasing a specific quantity, bundle or minimum order value, returning part of the order may affect the applicable promotion to the extent permitted by law.
11. REFUND METHOD
Refunds will normally be made using the same payment method used for the original purchase, unless otherwise agreed or technically impossible.
Depending on the payment method, banks and payment providers may require additional processing time before the refund appears in your account.
We do not control processing times imposed by your bank, card issuer or payment service provider.
12. REFUND TIMING
For valid EU statutory withdrawals, refunds will be processed within the period required by applicable law.
We may withhold reimbursement until:
- we have received the returned goods; or
- you provide evidence that the goods have been sent back,
whichever occurs first, where permitted by applicable law.
13. REFUSED OR UNCOLLECTED PARCELS
Refusing delivery or failing to collect a parcel does not automatically constitute a valid exercise of the statutory right of withdrawal.
If you wish to withdraw from your purchase, you should clearly notify us.
Where a shipment is returned because:
- delivery was refused;
- the parcel was not collected;
- an incorrect or incomplete delivery address was supplied;
we may deduct reasonable direct return or re-delivery costs from any refundable amount, where permitted by applicable law.
This does not affect your statutory rights in relation to defective or non-conforming goods.
14. EXCHANGES
Where available, exchanges may be handled as:
- return of the original product; and
- placement or shipment of a replacement product.
Availability of an exchange is not guaranteed until the replacement item is reserved or dispatched.
If an exchange relates to preference, size, colour or another non-defect reason, the customer may be responsible for applicable shipping costs.
If an exchange is required because the supplied product is defective, incorrect or non-conforming, the necessary shipping costs will be borne by us.
15. STATUTORY LEGAL GUARANTEE
Returns under the 14-day withdrawal right are different from claims concerning defective goods.
Consumers purchasing goods in the EU benefit from a minimum two-year statutory legal guarantee for goods that are defective or do not conform to the contract, although individual Member States may provide stronger protection.
These legal rights apply independently of our voluntary return policy.
16. ABUSE OF RETURN RIGHTS
We reserve the right to investigate return activity that reasonably appears fraudulent or abusive, including:
- returning a materially different item;
- returning counterfeit or substituted products;
- deliberately damaging goods;
- falsifying defect claims;
- repeated fraudulent chargeback activity.
We may refuse a fraudulent claim where legally permitted.
This provision does not restrict legitimate statutory consumer rights.
17. INTERNATIONAL RETURNS OUTSIDE THE EU
For customers outside the European Union, return rights may differ according to applicable local law.
Unless local mandatory law provides otherwise, our published return conditions will apply.
Customers may be responsible for:
- return shipping;
- customs paperwork;
- import/export documentation;
- other charges related to international returns.
Please contact us before returning products internationally.
